RANCHI, India, June 8 -- Jharkhand High Court issued the following order on May 8:
1. Mr. Nikhil Ranjan, the learned counsel for the appellant submits that the points involved in the present appeal are that deceased was not the third party and in view of that the liability cannot be fastened upon the insurance company in light of Section 163(A) of Motor Vehicle Act and only maximum of Rs.One lac can be awarded in favour of the deceased.
2. In view of the above facts, the insurance company is directed to deposit the entire awarded amount along with the interest before the learned Tribunal within three weeks and out of the deposited amount, Rs.One lac will be released in favour of the claimants on proper verification by the learned Tribunal. The rest of the amount shall be kept intact which will be subject to the result of the present appeal.
3. Issue notice upon the O.P.nos.1 to 8 by registered post with A/d as well as under ordinary process in main appeal as well as in the I.A meant for condonation of delay, for which requisites must be filed within one week after summer vacation.
