RANCHI, India, Feb. 9 -- Jharkhand High Court issued the following order on Jan. 9:
1. Heard the learned counsel for the parties.
2. The appellant is seeking condonation of delay of 911 days in filing this Letters Patent Appeal.
3. The only cause shown is that the appellant had paucity of funds and therefore, could not approach this Court earlier.
4. The learned counsel for the appellant further pointed out that the issue raised in this appeal is already decided against the appellant by the judgment and order dated 24th July 2025, passed in L.P.A. No. 735 of 2023. He pointed out that as against this judgment and order, a Special Leave Petition has been preferred before the Hon'ble Supreme Court and the same, to the best of learned counsel's knowledge, is posted for hearing on 20th January 2026.
5. Accordingly, the learned counsel for the appellant submitted that the delay may be condoned and the appeal disposed of, so that the appellant, despite his weak financial position, can explore the possibility of seeking redressal from the Hon'ble Supreme Court.
6. In the peculiar facts and since, according to the learned counsel for the appellant, the challenge to the order dated 24th July, 2025, disposing of LPA No. 735 of 2023 is being considered by the Hon'ble Supreme Court, we condone the delay and dispose of the Interlocutory Application No. 631 of 2025

7. Heard the learned counsel for the parties.
8. The appellant is seeking reinstatement as a Chaukidar on the ground that such a position is required to be filled in by way of "inheritance".
9. In L.P.A. No. 735 of 2023, this Court, vide its judgment and order dated 24th July, 2025 and to which, one of us (Sujit Narayan Prasad, J.) was a party, has held that no such appointment can be claimed by inheritance as, such a claim, would fall foul of the provisions in Article 14 and 16 of the Constitution of India.
10. The learned counsel for the appellant fairly accepts that the abovereferred decision would come in the way of the appellant. However, he points out that this Court's judgment and order dated 24th July 2025 in L.P.A. No. 735 of 2023 has been appealed in the Hon'ble Supreme Court. Therefore, he requests that this petition be disposed of so that the appellant can explore the possibility of approaching the Hon'ble Supreme Court with his grievance.
11. Accordingly, by following the precedent in Nijen Kumar Bhokta and Others Vs. The State of Jharkhand and Others (L.P.A. No. 735 of 2023 decided on 24th July 2025), and by adopting the reasoning therein, we dismiss this Letters Patent Appeal.
12. Pending application(s), if any, shall also stand disposed of.
