RANCHI, India, March 25 -- Jharkhand High Court issued the following order on Feb. 20:
Heard the parties.
Though notice has validly been served upon the opposite party No.2 yet no one turns up on behalf of the opposite party No.2 in spite of repeated calls.
This Criminal Miscellaneous Petition has been filed by the petitioner with a prayer for modification of the order dated 06.10.2023 passed in A.B.A. No.7767 of 2023.
Learned counsel for the petitioner submits that vide order dated 06.10.2023 passed in A.B.A. No.7767 of 2023, the petitioner was given the privileges of anticipatory bail and directed to surrender before the court below within six weeks from the date of that order on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of the learned JMFC, Giridih in connection with Complaint Case No. 2078 of 2020. It is next submitted that since the petitioner was working in Chennai and he could not be informed about this bail granted to him, hence, he could not surrender before the court concerned within the stipulated time. It is further submitted that now the petitioner is ready and willing to surrender before the learned court below and unless six weeks' extension is granted to him, he will be highly prejudiced. Hence, it is submitted that the time period for the petitioner to surrender before the court below in terms of the order dated 06.10.2023 passed in A.B.A. No.7767 of 2023 be extended by six weeks from the date of this order.
Considering the aforesaid submission of the learned counsel for the petitioner, the prayer for extension of time for the petitioner to surrender in the court below in terms of the order dated 06.10.2023 passed in A.B.A. No.7767 of 2023 is allowed. Accordingly, the order dated 06.10.2023 passed in A.B.A. No.7767 of 2023 is modified by directing the petitioner to surrender within six weeks from the date of this order in terms of the order dated 06.10.2023 passed in A.B.A. No.7767 of 2023.
The order dated 06.10.2023 passed in A.B.A. No.7767 of 2023 is modified to the aforesaid extent only.
This Criminal Miscellaneous Petition is disposed of accordingly.
