Learned counsel for the petitioner submits that this interlocutory application has been filed with a prayer for early hearing of the instant bail application.
Since, the hearing of instant bail application is taken up today, hence, this interlocutory application stands disposed of being infructuous.
B.A. No.1158 of 2025

The petitioner has been made accused in connection with Jamtara Cyber Crime P.S. Case No.79 of 2024 registered under Section 111(2)(ii), 317(2), 319(2), 318(4), 338, 336(3), 340(2) and 3(5) of the B.N.S., 2023 and Section 66 B, 66 C, 66 D of the Information Technology Act.
Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner was involved in cybercrime and he has defrauded the victim Agha Sayed Badrul Hasan to the tune of Rs.20,000/- and the petitioner has been implicated in this case, only on the basis of recovery of two mobile phones with two sim cards from his possession. It is submitted that the allegation against the petitioner is false. It is next submitted that the petitioner has no criminal antecedent as has been mentioned in para-16 of this bail application. It is then submitted that the petitioner undertakes that he will co-operate with the trial of the case and that he will transfer the respective amount allegedly defrauded from the bank account of the said victim. It is lastly submitted that the petitioner has been in custody since 24.12.2024 as is evident from para-15 of the instant bail application. Hence it is submitted that the petitioner be released on bail.
Learned Addl. P.P. opposes the prayer for bail.
Considering the facts of this case, the above-named petitioner is directed to be enlarged on bail on showing proof of transferring Rs.20,000/- to the account of Agha Sayed Badrul Hasan and on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Cyber Crime, Jamtara in connection with Jamtara Cyber Crime P.S. Case No.79 of 2024 with the condition that he will co-operate with the trial of the case and furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case.
