RANCHI, India, Aug. 25 -- Jharkhand High Court issued the following order on July 25:

1. The instant criminal revision petition has been preferred against the order dated 30.01.2025 passed in Original Maintenance Case No. 36 of 2022 by which a petition filed under Section 311 of Cr.P.C. was rejected.

2. On perusal of the materials on record, it appears that the maintenance case was filed on 24.05.2022 and the evidence of the applicant was closed on 16.11.2024. A prayer was made to recall the order by which the evidence was closed which has been rejected against which the instant criminal revision petition has been filed.

3. Learned counsel for the petitioner submits that the petitioner is ready to pay Rs.5,000/- as ordered by the learned court below on 10.02.2023 to the applicant. The petitioner also undertakes to conclude his evidence within 2 to 3 dates in a month.

4. Notice was earlier issued to opposite party no. 2 and was duly served to her, but she has not entered into her appearance.

5. Learned counsel for the State has defended the impugned order.

6. Considering the grounds taken, the petition for recall of the order dated 16.11.2024 passed by the Family Court, Ramgarh is allowed, subject to the condition of payment of Rs.10,000/- to opposite party no. 2.

One month's time is allowed to the petitioner to adduce his evidence, before the Family Court. This criminal revision petition stands disposed of.

Pending I.A., if any, also stands disposed of.
