RANCHI, India, Dec. 30 -- Jharkhand High Court issued the following order on Dec. 1:
1. The present writ petition has been filed for the following reliefs:-
"i. For issuance of an appropriate writ(s)/ order(s)/direction(s) particularly writ in the nature of Mandamus commanding upon the respondents and to send to this Hon'ble Court all records appertaining to the Land situated at Mauza Balsiring Thakur Tola P.S No. 253 Khata No. 87 and 88 Plot No 728,749,750,752,753,776,814,830,832,955 total measuring 17 acres and 73 decimals which is settled in the name of Khatiyani Raiyat Charu Oraon.
ii. To direct the respondents to take appropriate steps for the redressal of the grievances raised by the petitioners before the Deputy Commissioner Ranchi regarding the forceful encroachment being carried out by Land Mafias on the said land.
iii. To direct the respondents to restrain the land mafias from forcefully taking over 17 acres and 73 decimals Land of the petitioners.
iv. To direct the respondents to restore the land of the petitioners which has been forcefully taken over by the land mafia.
v. To direct the respondent no. 2 to dispose of the representation dated 17.06.2019 in accordance with law.
vi. For directing the respondents to conduct an inquiry in respect of the said land as to how in a most illegal manner the name of the Ancestor of the petitioner has been changed in the register-II."
2. Admittedly, the affected party or alleged affected party, who is contesting has not been made respondent party.
3. It is well settled law that in absence of necessary party, dispute cannot be maintained.
4. In view of above discussion, this Court finds no reason to entertain the present writ petition. Accordingly, the present writ petition stands dismissed.
5. However, the petitioners are at liberty to work out their further remedy in accordance with law.
