Learned counsel for the petitioner submits that this interlocutory application has been filed with a prayer for early hearing of the instant bail application.
Since, the hearing of instant bail application is taken up today, hence, this interlocutory application stands disposed of being infructuous.
B.A. No.48 of 2025
Heard the parties.
The petitioner has been made accused in connection with Latehar P.S. Case No.03 of 2023 registered for the offence punishable under Section 370(4), 370(5), 376(2)(n) of the Indian Penal Code and Section 6 of POCSO Act.
Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner committed aggravated penetrative sexual assault upon the minor victim girl. It is next submitted that the allegation against the petitioner is false. It is next submitted, drawing attention of this Court to the deposition of three witnesses including informant, who has been examined as PW-2, has categorically stated that her daughter has not stated anything to her, similarly, the PW-1 is also the mother of the one of the victim but she has stated in her deposition that the petitioner took the victim to Delhi but she has not seen the petitioner and PW-3 has also not stated anything to implicate the petitioner in this case. It is then submitted that the petitioner has been in custody since 19.10.2023 as is evident from para-17 of the instant bail application. It is next submitted that the petitioner has no criminal antecedent as has been mentioned in para-16 of this bail application. It is further submitted that the petitioner undertakes that he will not annoy or disturb the informant or witnesses of the case in any manner during the trial of the case. It is lastly submitted that the petitioner also undertakes to co-operate with the trial of the case. Hence, it is submitted that the petitioner be released on bail.
Learned counsel appearing for the State opposes the prayer for bail of the petitioner.
Considering the facts of this case, the above-named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, POCSO, Latehar in connection with Latehar P.S. Case No.03 of 2023 with the condition that he will cooperate with the trial of the case and furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case and he will not annoy or disturb the informant or witnesses of the case in any manner during the trial of the case.
