RANCHI, India, April 9 -- Jharkhand High Court issued the following order on March 9:
1. This bail application has been filed under Sections 483 and 484 of the BNSS, 2023 wherein, prayer has been made for grant of bail as the petitioner is in custody for allegedly committing offences punishable under Sections 309(6) of BNS, 2023.
2. Heard, the learned counsel for the petitioner and learned counsel for the State and have also gone through the impugned order.
3. The learned APP opposes the prayer for grant of bail.
4. The only material against the petitioner is that he has been named by one of co-accused on confession. There are no other materials and even though the charge-sheet has been submitted, the petitioner was not produced for Test Identification Parade.
5. Considering the aforesaid facts, I am inclined to grant bail to the petitioner. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Chaibasa in connection with Chaibasa Sadar P.S. Case No.67/2025 subject to the condition that one of the bailors should be close relative of the petitioner having sufficient landed property in his/her own name within the State of Jharkhand with a further condition that the petitioner shall appear and mark their attendance before the Registrar, Civil Court, Chaibasa once in a month till the disposal of the trial.
6. Accordingly, the bail application stands allowed.
