RANCHI, India, Nov. 30 -- Jharkhand High Court issued the following order on Oct. 30:

1. Heard learned counsel for the parties.

2. This civil miscellaneous petition has been filed with a prayer for restoration of Second Appeal No.176 of 2004 to its original file, which was stood dismissed for default by this Court vide order dated 17.07.2025.

3. It is submitted by the learned counsel for the petitioners that the matter was listed on 17.07.2025 before this Court but the arguing counsel could not attend the Court at the time of calling the matter due to his engagement in another Court, consequently, the case was dismissed for default. It is further submitted that there is no deliberate inaction on the part of petitioners. Petitioners have very good grounds to agitate in S.A. No.176 of 2004 and unless S.A. No.176 of 2004 is restored to its original file, the petitioners will be highly prejudiced. Hence, it is submitted that S.A. No.176 of 2004 may be restored to its original file.

4. Considering the aforesaid submission of the learned counsel for the petitioners and for the ends of justice, S.A. No.176 of 2004 is restored to its original file.

5. Registry is directed to list S.A. No.176 of 2004 before the concerned Bench.

6. This civil miscellaneous petition is allowed accordingly.
