RANCHI, India, June 28 -- Jharkhand High Court issued the following order on May 29:
1. The petitioner apprehending his arrest in connection with Latehar P.S. Case No. 122 of 2023, for the offences punishable under Sections 147, 148,149,323, 332, 333, 341, 342, 353, 379, 504, 506 of the Indian Penal Code, pending in the Court of the learned Chief Judicial Magistrate, Latehar, has prayed for grant of anticipatory bail.
2. Learned Counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged in the F.I.R. As per allegation, the petitioner being part of unlawful assembly and having Lathi, Danda and Iron rod, used criminal force against public servant/ police personnel and deterred them from discharging their official duty. It has further been alleged that the members of the unlawful assembly tried to snatch arms of the police party and committed theft of mobile phones. It is also submitted that though the petitioner was present at the place of occurrence as a child had luckly escaped from being run down by a Hywa vehicle while a family function was going on there, he was not involved in commission of the alleged offence. The petitioner has no criminal antecedent as has been stated in para 13 of the present anticipatory bail application. The petitioner, however, undertakes to co-operate in the investigation. Hence, he may be given the privilege of anticipatory bail.
3. Learned A.P.P. opposes the petitioner's prayer for grant of anticipatory bail.
4. Having heard learned counsel for the parties and considering the material available on record, I am inclined to enlarge the petitioner on anticipatory bail.
5. Accordingly, the petitioner, above named, in the event of his arrest or surrender before the court below within three weeks from today, shall be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Latehar in connection with Latehar P.S. Case No. 122 of 2023, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
