RANCHI, India, Feb. 8 -- Jharkhand High Court issued the following order on Jan. 8:

1. Heard learned counsel representing the petitioner and learned counsel representing the respondents.

2. It is the case of the petitioner that the grandfather of this petitioner who was working as Dalpati in Banari who died in harness on 16.08.1991. It is his case that thereafter neither the death benefit has been disbursed nor the compassionate appointment has been given. The petitioner thus seeks compassionate appointment and death benefits.

3. Learned counsel for the respondents submit that Dalpati is not a government post on which the grandfather of the petitioner was working, thus, he is not entitled for any benefit.

4. The aforesaid submission is not denied by the petitioner.

5. Admittedly the grandfather of the petitioner died on 16.08.1991. The petitioner being the grandson has got no right to get compassionate appointment. Further 34 years have passed from the date of death of the grandfather and the family has survived for these long years, thus, there is no ground to give compassionate appointment in lieu of death of grandfather of the petitioner.

6. Further, since Dalpati is not a government post thus no relief can be granted to the petitioner so far as other benefits is concerned.

7. Accordingly, this writ petition is dismissed.
