RANCHI, India, Feb. 7 -- Jharkhand High Court issued the following order on Jan. 6:
I.A. No. 16344 of 2025
1. Heard Ms. Vidhika Saboo, learned counsel for the appellant and learned A.P.P.
2. This application has been preferred by the appellant for condoning the delay of 13 days in filing the appeal.
3. Having been satisfied with the reasons assigned in the instant application, the same is allowed and the delay of 13 days in filing the appeal is hereby condoned.
4. I.A. No. 16344 of 2025 stands disposed of.

5. This appeal is directed against the order dated 15.09.2025 passed in Misc. Criminal Application No.530 of 2025, arising out of Sundarpahari P.S. Case No. 72 of 2015, by the learned Addl. Sessions Judge-IV, Godda, whereby and where under the prayer for bail of the appellant has been rejected.
6. It has been alleged that there was an exchange of firing between the police personnel and the extremists as a result of which two police personnel had died and some had suffered injuries and several arms and ammunitions and other incriminating materials were recovered from the place of occurrence.
7. Submission has been advanced by the learned counsel for the appellant that though the appellant is named in the F.I.R. but the manner of implication appears to be the extremists calling each other by name while firing at the police personnel. It has further been submitted that the appellant is in custody since 06.04.2022 and one of the co-accused namely Mithlesh Mandal has been granted bail by the co-ordinate bench of this Court in Cr. A. (DB) No. 941 of 2022.
8. Learned A.P.P. has opposed the prayer for bail of the appellant.
9. Regard being had to the manner of implication and the fact that one of the co-accused has been granted bail, we while setting aside the order dated 15.09.2025 passed in Misc. Criminal Application No.530 of 2025, arising out of Sundarpahari P.S. Case No. 72 of 2015, by the learned Addl. Sessions Judge-IV, Godda, direct the appellant to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Addl. Sessions Judge-IV, Godda, subject to the condition that the appellant shall remain physically present on each and every date till the conclusion of the trial unless prevented by sufficient cause
10. Accordingly, this appeal stands allowed and disposed of.
