RANCHI, India, April 20 -- Jharkhand High Court issued the following order on March 19:
1. Petitioner is challenging the initiation of BPLE Case No.21/2017- 18, on the ground of the same being without jurisdiction and the land is settled land.
2. Since, only a notice has been issued to the petitioner, I am not inclined to interfere in the proceeding.
3. The petitioner may highlight his defence by filing reply, along with document if any before the authority concerned, who will consider the same and thereafter will pass an appropriate order as per law after hearing the parties.
4. Accordingly, the instant writ petition stands disposed of.
5. It is made clear that without passing any final order, the petitioner cannot be dispossessed.
6. Once the order is passed, the same should be communicated within 48 Hours to the petitioner.
