Heard Mr. Jitendra Nath Upadhyay, learned counsel for the appellant and Mr. Subodh Kr. Dubey, learned A.P.P.
This application has been preferred by the appellant for condoning a delay of 43 days in filing the appeal. Having been satisfied with the reasons assigned in the instant application, the same is allowed and a delay of 43 days in filling the appeal is hereby condoned.
I.A. No. 7618 of 2025 stands disposed of.
Cr. Appeal (DB) No. 721 of 2025.
This appeal is directed against the order dated 17.03.2025 passed by the learned Sessions Judge-I, Seraikella in M.C.R.A. No. 323/2025 corresponding to S.T. Case No. 105/2023 arising out of R.I.T. P.S. Case No. 26/2022, whereby and whereunder, the prayer for bail of the appellant has been rejected.
The appellant had earlier moved this Court for grant of bail in Cr. Appeal (DB) No. 456 of 2024 which was dismissed on 09.05.2024.
Submission has been advanced by the learned counsel for the appellant that the appellant is in custody since 08.06.2022. It has further been submitted that five charge sheet witnesses have been examined by the prosecution.
Learned A.P.P. has opposed the prayer for bail of the appellant.
The evidence of the witnesses so far examined and which has been brought on record by the learned counsel for the appellant reveals that it was the appellant who had shot at the brother of the informant which resulted in his death.
Regard being had to the specific nature of allegations levelled against the appellant and the fact that the trial is progressing, we are not inclined to interfere in the impugned order dated 17.03.2025 passed by the learned Sessions Judge-I, Seraikella in M.C.R.A. No. 323/2025 corresponding to S.T. Case No. 105/2023 arising out of R.I.T. P.S. Case No. 26/2022 and consequently, we dismiss this appeal.
