RANCHI, India, Feb. 19 -- Jharkhand High Court issued the following order on Jan. 19:

1. Heard the parties.

2. It is the case of the petitioner that the petitioner has not been promoted for a single occasion, thus he is entitled for the benefit of ACP/MACP which are also not been granted to the petitioner in his entire tenure.

3. It is the case of the petitioner that he has already now superannuated.

4. Learned counsel appearing on behalf of the respondents submits that the petitioner should file an appropriate representation which can be considered and an appropriate order will be passed. If the order finds favour to the petitioner, the retiral benefits should be re-calculated and re-assessed and the arrears should also be paid.

5. Considering the submission of the parties, I direct the petitioner to file a fresh representation within four weeks before the Principal Secretary, Personnel, Administrative & Rajbhasha Department, Government of Jharkhand, Ranchi. On receipt of the said representation, the case of the petitioner will be considered within six weeks and if it is necessary to place the case before any committee or any authority, the same should be placed during the said period.

6. If it is found that the petitioner is entitled for any benefit, the same will be granted within four weeks thereafter.

7. If any part of the claim of the petitioner is rejected, the reasons thereof should be communicated to the petitioner within the aforesaid period.

8. With the aforesaid observations, this writ petition stands disposed of.
