RANCHI, India, Feb. 12 -- Jharkhand High Court issued the following order on Jan. 12:
1. Heard learned counsel for the petitioner and learned counsel for the State.
2. The petitioner is seeking regular bail in connection with S.T. Case No. 173 of 2025, arising out of Masalia P.S. Case No. 33 of 2025 registered under Section 64(1) of Bhartiya Nyaya Sanhita, 2023, pending in the Court of learned Additional Sessions Judge-II, Dumka.
3. Learned counsel appearing for the petitioner submits that petitioner has falsely been implicated in this case due to village politics. He next submits that the petitioner is Village Pradhan and initially the FIR was registered under Section 64(1) of the Bhartiya Nyaya Sanhita, 2023, however, chargesheet has been submitted under Section 75 (2) of Bhartiya Nyaya Sanhita, 2023 for which 3 years imprisonment , or with fine or with both penalties are there. He submits that petitioner is in custody since 23.07.2025.
4. Learned A.P.P. for the State has opposed the prayer for bail of the petitioner and submits that the allegations are there that the petitioner has entered into the house of the informant and molested her.

Considering that initially the FIR was registered under Section 64(1) of the B.N.S., 2023, however the chargesheet has been submitted under Section 75 (2) of the B.N.S., 2023 and the petitioner is in custody since 23.07.2025 and in paragraph 17 of the bail application, it is stated that petitioner has got no criminal antecedent and in the attending facts and circumstances of the case, I am inclined to grant regular bail to the petitioner.

Accordingly, the petitioner, above named, shall be released on regular bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-II, Dumka, in connection with S.T. Case No. 173 of 2025, arising out of Masalia P.S. Case No. 33 of 2025.
