RANCHI, India, April 13 -- Jharkhand High Court issued the following order on March 11:
1. Heard the parties.
2. It is the prayer of the petitioners that the date of 1st Time Bound Promotion should be corrected and be fixed as 20.10.1983 instead of 01.07.1984 (so far as petitioner No.1) and 13.10.1983 in place of 01.07.1984, so far as petitioner No.2 is concerned.
3. It is the grievance of the petitioners that the though petitioner No.1 has been appointed on 20.10.1973 and petitioner No.2 on 13.10.1973 on the post of Assistant Teachers but their date of 1st Time Bound Promotion has been wrongly fixed. He submits that the date of the 1st Time Bound Promotion should be fixed taking into consideration the date of their respective appointment and not from the date of grant of pay-scale.

He submits that they have filed a detailed representation and also similarly situated teachers also filed representations and their case were considered and their dates have been shifted but the case of the petitioners has not been considered. He refers to Annexure-5 & 5/1 of the writ petition in support of their claim.

Learned counsel appearing on behalf of the respondents submits that if the petitioners file fresh representations, annexing all the documents and if it is found that the case of the petitioners are exactly similar to that of the persons whose cases were considered pursuant to the order passed by this Court which is at Annexure-5 & 5/1, the case of the petitioners can also be considered.

Considering the said submission, I direct the petitioners to file a fresh representation, annexing all the documents within four weeks before the District Superintendent of Education, Dumka-respondent No.6. On receipt of the said representation, the case of the petitioners will be considered within six weeks and if it is necessary to place the case before any committee or any authority, the same should be placed during the said period.
7. If it is found that the petitioners are entitled for any benefits, the same will be granted within four weeks thereafter.
8. If any part of the claim of the petitioners is rejected, the reasons should be communicated to the petitioners within the aforesaid period.
9. With the aforesaid observations, this writ petition stands disposed of.
