RANCHI, India, March 8 -- Jharkhand High Court issued the following order on Feb. 6:

Heard Mr. Rajesh Kumar Mahtha, learned counsel appearing for the appellant. None appears for the State.

This appeal is directed against the order dated 18.12.2025 passed in Misc. Cri. Application No. 335 of 2025 arising out of Chandrapura P. S. Case No. 190 of 2014 corresponding to S. T. No. 238 of 2025 by the learned Additional Sessions Judge - I, Bermo at Tenughat whereby and whereunder the prayer for bail of the appellant has been rejected.

It has been alleged that some persons were seen fleeing away with jerrycan containing diesel and on chase one Mukesh Mahto was apprehended and from his possession several incriminating articles have been recovered.

Learned counsel for the appellant submitted that the appellant has been apprehended on the basis of confessional statement of Mukesh Mahto. He has further submitted that the appellant is in custody since 02.12.2025.

Regard being had to the manner of implication of the appellant, we while setting aside the order dated 18.12.2025 passed in Misc. Cri. Application No. 335 of 2025 by the learned Additional Sessions Judge - I, Bermo at Tenughat, direct that the appellant above named be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each, to the satisfaction of the learned Additional Sessions Judge - I, Bermo at Tenughat in connection with Chandrapura P. S. Case No. 190 of 2014 corresponding to S. T. No. 238 of 2025, subject to the condition that the appellant shall remain physically present before the learned trial court on each and every date till the conclusion of trial, unless prevented by sufficient cause.

This appeal is allowed.
