RANCHI, India, July 28 -- Jharkhand High Court issued the following order on June 30:
1. The instant writ petition has been filed against the impugned order (JH/RO/ RAN/PD/ JHRAN 1810010/2023-24/229/1755) dated 12.04.2024 and demand notice (JH/RO/ RAN/PD/ JHRAN 1810010/2023-24/229) dated 23.04.2024 issued both under signature of Regional Provident Fund Commissioner-II dated 30.04.2024 against the petitioner, wherein the petitioner Company has been directed to pay the penalty and interest amount for default in contribution to the Employees' Provident Fund.
2. It is contended that the petitioner has already preferred the appeal before the Central Government Industrial Tribunal (CGIT)-II at Dhanbad in EPFA No. 23 of 2024 but the same has not been heard for a long time as the post of Presiding Officer was vacant.
3. Mr. PAS Pati, learned counsel appearing for the EPF submits that at present, CGIT, Dhanbad is in seisin with the matter and the case is listed for hearing on 15.07.2025. A notice is also filed stating that the Presiding Officer Sachindra Kumar Pandey has joined on 23.05.2025 and consequently, the court will commence its proceeding on regular basis from 11:00 am onwards.
4. In view of the above admitted facts regarding CGIT, Dhanbad being functional at present, the matter is disposed with direction to the CGIT, Dhanbad to dispose of EPFA No. 23 of 2024 within a period of 12 weeks from the date of receipt/production of a copy of this order.
This writ petition stands disposed of. Pending I.A., if any, also stands disposed of.
