RANCHI, India, March 28 -- Jharkhand High Court issued the following order on Feb. 24:

1. Heard the parties.

2. The present writ petition has been filed for the following reliefs:-

"i. For quashing of order dated 14.9.2021 (Annexure-6) under section 7A read with 14B and 7Q of Employees Provident Funds and Miscellaneous Act, 1952 (hereinafter as "Act") passed by Mr. Rakesh Kumar Sinha, Assistant P F Commissioner, Regional Office, Jamshedpur in violation of Section 16 of Employees Provident Funds and Miscellaneous Act, 1952 and without considering the provision of BIHAR MUNICIPAL OFFICER AND SERVANTS PENSION Rules, 1987(Adopted by Jharkhand),

ii. For quashing of order contained in letter No.336 dated 26.7.2024 (Annexure- 10) passed by Mr. Shashi Bhushan Kumar, Regional P F Commissioner, Regional Office, Jamshedpur, who has rejected petition of section 7B of EPF & M Act, 1952 on technical ground without deciding the merit of the case on review and also not given any opportunity for hearing to the petitioner.

iii. For warrant of attachment of movable property of petitioner issued by Provident Fund Organization by which ICICI Bank, Chaibasa Branch has issued two drafts a sum of Rs. 54,29,787/- in favour of Organization without any consent/ approval of Petitioner and same has been communicated vide letter dated 19.1.2023 (Annexure-9).

iv. For quashing of letter no.809 dated 14.6.2024 (Annexure-11) which has been initiated proceeding of U/S 14(B) of Employees Provident Funds and Miscellaneous Act, 1952.

v. For direction upon the respondents to close the UAN Account of Ex. And present Employees of Nagar Parishad, which is submitted by letter no. 533 dated 09.6.25 (Annexure 16 series) to the office of respondent in light of letter no. 86 dated 16.5.2025. vi. During pendency of writ application, staying the (Annexure- 6, 10 & 14) till the final disposal of this case."

3. It has been objected by the other sides stating that there is a provision for appeal.

4. In that view of the matter, learned counsel for the petitioner seeks permission to withdraw the present writ petition with a liberty to approach the appellate authority.

5. Permission is accorded. 6. Accordingly, the present writ petition stands disposed of with the aforesaid liberty.
