RANCHI, India, Feb. 12 -- Jharkhand High Court issued the following order on Jan. 12:
1. Heard learned counsel for the petitioner and learned counsel for the State.
2. The petitioner is seeking regular bail in connection with Jharia P.S. Case No. 212/2024, registered under Sections 319(2), 318(4), 338, 336(3), 340(2), 61 of the BNS, pending in the Court of learned A.C.J.M, Dhanbad.
3. Learned counsel appearing for the petitioner submits that allegation is made against the petitioner that he has transported the vehicle from Dhanbad to the State of Gujarat which has been purchased by finance. He submits that the same allegation is there against Nikunj Ashok Nathani who has been granted regular bail by a Coordinate Bench of this Court in B.A. No. 6668 of 2025. He submits that petitioner is in custody since 28.09.2024.
4. Learned A.P.P. for the State has opposed the prayer for bail of the petitioner and submits that the petitioner has transported the said vehicle in the State of Gujarat.
5. Considering that in identical situation, a co-accused person, namely, Nikunj Ashok Nathani has been granted regular bail by a Coordinate Bench of this Court and the petitioner is in custody since 28.09.2024, I am inclined to grant regular bail to the petitioner.
6. Accordingly, the petitioner, above named, shall be released on regular bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each, to the satisfaction of learned A.C.J.M, Dhanbad, in connection with Jharia P.S. Case No. 212/2024.
