RANCHI, India, Nov. 2 -- Jharkhand High Court issued the following order on Oct. 6:
1. Heard learned counsel appearing for the petitioners, learned counsel appearing for the State and learned counsel appearing for the Union of India.
2. The petitioners are apprehending their arrest in connection with RPF/POST/TATA Case No.5 of 2025, R.A. Case No.714 of 2025, registered for the offence under Section 3(a) of Railway Property (Unlawful Possession) Act, pending in the Court of the learned Railway Judicial Magistrate, Porahat (Chaibasa).
3. Learned counsel appearing for the petitioners submits that false allegations are made against the petitioners of misappropriation of 1259 bags of rice from the Railway yard. He further submits that the petitioners are employees of TATA. He then submits that the petitioners have got no criminal antecedents, as disclosed in paragraph 13 of this application. He next submits that only on the basis of being in-charge of the said yard, the petitioners have been implicated in the case. He further submits that two of the co-accused persons have been granted regular bail by the learned trial court. He also submits that the petitioners will co-operate in the investigation.
4. Learned counsel appearing for the State and Union of India jointly opposed the prayer and submit that the allegations are there of misappropriation of 1259 rice packets.

Considering that the petitioners are said to be employees of TATA and they have got no criminal antecedents and only because they are in-charge of the said yard, they have been implicated in the case and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioners.
6. Accordingly, the above-named petitioners are directed to surrender before the learned Court within three weeks from today and in the event of their arrest or surrender, they will be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Porahat (Chaibasa) in connection with RPF/POST/TATA Case No.05 of 2025, R.A. Case No.714 of 2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
