RANCHI, India, Dec. 25 -- Jharkhand High Court issued the following order on Nov. 25:
1. Heard the parties.
2. Heard learned counsel for the petitioner and learned counsel appearing for the State and O.P. No.2
3. Learned counsel appearing for the petitioner submits that the petitioner is the husband and the maintenance order dated 03.03.2022 passed by the learned Principal Judge, Family Court, Jamshedpur in Original Maintenance Case No.135 of 2018 is under challenge. He submits that during the pendency of this criminal revision, a good sense has prevailed between the petitioner and O.P. No.2 and both have reached to a compromise and the compromise has been brought on record by way of filing I.A. No.6636 of 2025. He submits that the said settlement has arrived before the JHALSA and the matter is sent by the Coordinate Bench for settlement. He submits that in light of the settlement, the petitioner has already paid a sum of Rs.18 lakh and the matter has been settled on total payment of Rs.28 lakhs. He submits that both the sides have filed the mutual divorce petition before the learned Family Court, Jamshedpur and it has been agreed that at the time of mutual decree of divorce, rest amount of Rs.10 lakh is to be paid to the O.P. No.2.
4. Mr. Dayal, learned counsel appearing for the O.P. No.2 fairly accepts the submission that the I.A. has been filed and the terms and conditions has been disclosed in the said I.A. He submits that in view of the settlement, the maintenance order will be merged in one time alimony as agreed in terms of decree, which is to be passed by the learned Family Court Judge.
5. In view of the above the submission of the learned counsel for the parties, this Criminal Revision is disposed of observing that the maintenance order will merge with the one time alimony to be passed by the learned Family Court. Pending petition if any also stands disposed of
