RANCHI, India, May 1 -- Jharkhand High Court issued the following order on March 30:
1. Heard the parties.
2. It is the grievance of the petitioner that for the same nature of land, the petitioner has been paid a less amount of compensation, though his brother has received more.
3. Learned counsel appearing on behalf of the NHAI submits that the land has been acquired in terms of the provision of National Highways Act, 1956. It is his contention that the petitioner should approach the appropriate authority under the National Highways Act, for redressal of his grievance.
4. Considering the said submission and after considering the admitted fact that the land has been acquired in terms of the National Highways Act, I direct the petitioner to invoke the relevant provisions of the National Highways Act, 1956 before the appropriate authority within a period of four weeks. If the petitioner files an appropriate application by invoking the provisions of the National Highways Act, his case will be considered and the authority should proceed in terms of the provisions laid down in the Act for redressal of the grievance of the petitioner.
5. With the aforesaid observation, this writ petition stands disposed of.
