RANCHI, India, Aug. 18 -- Jharkhand High Court issued the following order on July 17:

1. Heard Mr. Anupam Anand, learned counsel appearing for the appellant and Mr. Rajneesh Vardhan, learned A.P.P. appearing for the State.

2. This appeal has been directed against the order dated 17.01.2025 passed by the learned Additional Sessions Judge-I, Chatra in connection with Simaria P.S. Case No. 161 of 2022 (S.T. No. 122 of 2023); whereby and whereunder the prayer for bail of the appellant has been rejected.

3. It appears that the appellant has earlier moved for grant of bail before this Court in Cr. Appeal (DB) No. 288 of 2024 which however was dismissed on 09.05.2024.

4. It has been submitted by learned counsel for the appellant that out of 10 charge-sheeted witnesses 8 witnesses have been examined so far.

5. Learned counsel submits that the appellant is in custody since 01.09.2022.

6. Learned APP has opposed the prayer for bail of the appellant and has submitted that the appellant has got several criminal antecedents.

7. The allegations reveal that on a raid conducted by the police, a rifle was recovered from the possession of the appellant.

8. Considering the fact that the appellant has remained in custody for almost 3 years, we while setting aside the order dated 17.01.2025 passed by the learned Additional Sessions Judge-I, Chatra in connection with Simariya P.S. Case No. 161 of 2022 (S.T. No. 122 of 2023 (MCA No. 74 of 2025), direct that the appellant above named be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each, to the satisfaction of the learned Additional Sessions Judge-I, Chatra in connection with Simaria P.S. Case No. 161 of 2022 (S.T. No. 122 of 2023, subject to the condition that the appellant shall remain physically present before the learned trial court on each and every date till conclusion of the trial.

9. Accordingly, this appeal is allowed.
