RANCHI, India, June 8 -- Jharkhand High Court issued the following order on May 8:
Heard the learned counsel for the respective sides.
This appeal is directed against the order dated 30.11.2024 passed in B.P. No. 229 of 2024 in connection with Chakradharpour Case No. 60/2024 by learned Additional Sessions Judge-III, Chaibasa, whereby and whereunder, the prayer for bail of the appellants has been rejected.
It has been alleged that the informant was forcibly taken by the appellants and others accused persons to Madhya Pradesh, where she was sold and the appellants had taken an amount of Rs. 1.5 Lakhs for arranging the marriage of the informant with a blind person.
Submission has been advanced by the learned counsel for the appellants that the appellant No. 1 is in custody since 25.09.2024 while the appellant No. 2 is in custody since 30.09.2024. It has further been submitted that there is no allegation that the appellants had forcibly taken the informant to Madhya Pradesh.
Learned APP has opposed the prayer for bail of the appellants.
Regard being had to the period of custody undergone by the appellants, we while setting aside the order dated 30.11.2024 passed in B.P. No. 229 of 2024 in connection with Chakradharpour Case No. 26/2024 by learned Additional Sessions Judge-III, Chaibasa, direct that the appellant be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like mount each to the satisfaction of learned SDJM, West Singhbhum at Chaibasa in connection with Chakradharpour Case No. 60/2024.
This appeal is allowed.
