RANCHI, India, Feb. 12 -- Jharkhand High Court issued the following order on Jan. 12:

1. Heard learned counsel appearing on behalf of Petitioners and learned counsel appearing on behalf of the State.

2. The petitioners are apprehending their arrest in connection with Deodanar P.S. Case No.28 of 2025 registered offence under sections191(2), 190, 115(2), 117(2), 298, 324(4), 324(5), 352 of BNS, 2023 & Section 3/4 Daain (Witch) Practices Act, 2001, pending in the court of the learned S.D.J.M., Godda.

3. Learned counsel appearing for the petitioners submits that false allegations are made against the petitioners and due to land dispute altercation took place. He next submits that petitioners and informant sides are the residents of same village. He also submits that even the date of alleged occurrence is not disclosed in the FIR. He then submits that no article has been recovered from the place of occurrence. He next submits that the petitioner has got no criminal antecedent as disclosed in Para- 17 of the Petition.

4. Learned counsel appearing for the State opposed the prayer and submits that allegation of prevention of Witch (Daain) Practices is also there.

5. Looking into the contents of the FIR, it transpires that even the date of alleged occurrence is not disclosed. It has been pointed out that there is land dispute between the parties and the petitioners have got no criminal antecedent as disclosed in Para 17 of the petition, I am inclined to grant anticipatory bail to the petitioners.

6. Accordingly, the petitioners above named are directed to surrender before the learned Court within three weeks from the date of receipt of the order and on the event of their surrender / arrest, they shall be released on bail on furnishing bail bond of Rs.25,000/- (Twenty-Five Thousand) each with two sureties of the like amount of each to the satisfaction of learned S.D.J.M., Godda, in connection with Deodanar P.S. Case No.28 of 2025, subject to the condition as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.

7. This Anticipatory Bail Application is accordingly allowed and disposed of.
