RANCHI, India, Jan. 24 -- Jharkhand High Court issued the following order on Dec. 23:

Heard Mr. Gautam Kumar, learned counsel for the appellant and learned Spl. P.P.

This appeal is directed against the order dated 09.12.2025 passed by the learned Additional Sessions Judge-I, Pakur in B.P. No. 356/2025 in connection with Hiranpur P.S. Case No. 105/2025, whereby and whereunder, the prayer for bail of the appellant has been rejected.

It has been alleged that on account of blasting in mines, stones had fallen in the courtyard of the house of the villagers and cracks had also appeared in several houses and roads. When the said incident was protested by the villagers, the mines owner along with his associates variously armed had abused and assaulted the villagers as a result of which some of the villagers had sustained injuries.

It has been submitted by learned counsel for the appellant that the appellant is in custody since 03.11.2025. It has further been submitted that in similar circumstances some of the co-accused have been granted bail by this Court in Cr. Appeal (DB) No. 28945 of 2025 (Filing No.).

Learned Spl. P.P. has opposed the prayer for bail of the appellant.

Regard being had to the fact that the case of the appellant appears to be similarly situated to that of the co-accused who have been granted bail as noted above, we while setting aside the order dated 09.12.2025 passed by the learned Additional Sessions Judge-I, Pakur in B.P. No. 356/2025 in connection with Hiranpur P.S. Case No. 105/2025 direct that the appellant be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Pakur.

This appeal is allowed.
