RANCHI, India, Sept. 24 -- Jharkhand High Court issued the following order on Aug. 25:

1. The appellants are the claimants in whose favour, award of compensation has been made in OA Case No. (IIU)/RNC/2014/0022. The appeal is for enhancement of compensation as the interest has not been awarded from the date of accident as per the mandate of law under Section 124 of the Railways Act, 1989.

2. It has been submitted by learned counsel for the appellants that the compensation on the interest has been awarded from the date of award.

3. Learned counsel for the respondent has defended the impugned order and submitted that it was the laches on the part of the claimants for the delay in disposal of the case. Consequently, the interest was not awarded.

4. The ground on which the interest has been denied is not sustainable and, accordingly, in view of the ratio laid down by the Hon'ble Apex Court in AIR 2018 SC 2362 (Union of India Vs. Rina Devi), the interest at the rate of 7.5% from the date of accident, is allowed.

This Misc. Appeal stands disposed of.

Pending I.A., if any, also stands disposed of.
