RANCHI, India, Feb. 14 -- Jharkhand High Court issued the following order on Jan. 13:
1. Heard learned counsel appearing on behalf of Petitioners and learned counsel appearing on behalf of the State.
2. The petitioners are apprehending their arrest in connection with Sarath P.S. Case No.73 of 2025, for the alleged offences registered under Sections 190, 191(2), 126(2), 115(2), 121(1), 125(b), 132, 117(3), 118(1), 109, 351(2) and 352 of Bharatiya Nyaya Sanhita, 2023, pending in the Court of learned Judicial Magistrate, 1st Class, Madhupur.
3. Learned counsel appearing for the petitioners submits that the FIR has been registered against 50 named persons and 50 to 60 unknown persons. He also submits that there are general and omnibus allegation against the accused persons including the petitioners and the allegations are made that when the police party came to the village for raiding the house of one of the person, the villagers assembled and started pelting stones. He next submits that in identical situation, co-accused persons have been granted anticipatory bail in ABA No.5906 of 2025, ABA No.5931 of 2025 and ABA No.5955 of 2025.
4. Learned counsel appearing for the State opposed the prayer and submits that the allegations are there of pelting stones upon the police force.

Considering that there are 50 named accused persons and the allegations are also there against 50 to 60 unknown persons and there are general and omnibus allegation against all the accused persons including the petitioners and in identical situation co-accused persons have already been granted anticipatory bail in aforesaid ABAs, I am inclined to grant anticipatory bail to the petitioners.

Accordingly, the petitioners above named are directed to surrender before the learned Court within three weeks from the date of receipt of the order and on the event of their surrender / arrest, they shall be released on bail on furnishing bail bond of Rs.25,000/- (Twenty-Five Thousand) each with two sureties of the like amount of each to the satisfaction of learned Judicial Magistrate, 1st Class, Madhupur, in connection with Sarath P.S. Case No.73 of 2025, subject to the condition as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
7. This Anticipatory Bail Application is accordingly allowed and disposed of.
