RANCHI, India, Oct. 23 -- Jharkhand High Court issued the following order on Sept. 23:

Heard Mr. Mohit Prakash, the learned counsel for the appellant and Mr. Vineet Kumar Vashistha, the learned Spl.P.P.

This appeal is directed against the order dated 01.08.2025 passed by the learned Additional Sessions Judge-I-cum-Spl. Judge, Gumla in B.P. No.460/2025 arising out of Raidih PS Case No. 23/2025, whereby and whereunder, the prayer for bail of the appellant has been rejected.

It has been alleged that sometime in December, 2004 the daughter of the informant had gone to Delhi and subsequent thereto, the informant was not able to contact his daughter leading to institution of the First Information Report. It has further been alleged that his daughter has been sold by the present appellant.

Submission has been advanced by the learned counsel for the appellant that there has been a subsequent development in the case as the matter has been compromised, consequent to which, the informant as well as the victim did not support the case of the prosecution and were declared hostile by the prosecution. The learned counsel adds that the appellant is in custody since 17.04.2025.

The evidence of the victim and the informant has been produced at the Bar by the learned counsel for the appellant which has been perused and from which it appears that both have been declared hostile by the prosecution.

On consideration of the aforesaid, we while setting aside the order dated 01.08.2025 passed by the learned Additional Sessions JudgeI-cum-Spl. Judge, Gumla in B.P. No.460/2025 arising out of Raidih PS Case No. 23/2025 direct the appellant be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-Icum-Spl. Judge, Gumla in connection with Raidih PS Case No. 23/2025 (ST Case No. 159/2025).

This appeal is allowed.
