RANCHI, India, Feb. 23 -- Jharkhand High Court issued the following order on Jan. 22:
1. Heard learned counsel representing the petitioners and the learned counsel representing the respondents.
2. It is the grievance of the petitioners that they have not been paid benefits of 2 nd and 3 rd MACP and some of them have not been paid pension. It has been submitted that representations have been filed but their representations have not been considered.
3. Learned counsel for the State submits that this writ petition can be disposed of directing the respondents to consider the representation of the petitioners and pass a reasoned order.
4. Considering the said submission, I direct all the petitioners to file separate individual applications within four weeks before the respondent no. 2 - the Secretary, Department of Agriculture, Animal Husbandry and Cooperative Department who will consider the claim of the individual petitioners within six weeks thereafter and if the petitioners are entitled for any relief for enhancement of the pay-scale or pension the same should be granted to them. An appropriate order to that effect should be passed within four weeks thereafter. If it is found that the petitioners are not entitled for any relief the reasons thereof should be communicated to the petitioners. If the petitioners are entitled for any monetary benefits or interim relief the same should be extended to the petitioners.
5. The entire process should be concluded within the period of 14 weeks from the date of receipt of the copy of this order.
6. Accordingly, this writ petition is disposed of.
