RANCHI, India, Dec. 17 -- Jharkhand High Court issued the following order on Nov. 17:

Heard the parties.

By filing this writ petition, the petitioner is seeking compassionate appointment in postal department.

As per Section 14 of the Administrative Tribunal Act 1985, the service dispute in relation to postal department should be placed before the Central Administrative Tribunal.

Further the Hon'ble Supreme Court in the case of Leelavathi N. and Others Vs. State of Karnataka and Ors. reported in 2025 SCC OnLine SC 2253 has held that where the Tribunal has jurisdiction to decide the issue, the High Court should not entertain the writ petition. Further, initially the petitioner approached the Central Administrative Tribunal by filing an application but later on the same was withdrawn to file an application before the Postal Department. After rejection of the same, the petitioner has approached this Court by filing this petition under Article 226 of the Constitution seeking compassionate appointment without filing any application before the Central Administrative Tribunal.

Thus, I am not inclined to entertain this writ petition. Accordingly, the same is dismissed with liberty to the petitioner to approach before the Central Administrative Tribunal by filing appropriate application.
