RANCHI, India, July 7 -- Jharkhand High Court issued the following order on June 6:

Heard Mr. Vikas Kumar, learned counsel for the appellant and Mr. Anup Pawan Topno, learned A.P.P.

This appeal is directed against the order dated 29.11.2024 passed by the learned Additional Sessions Judge-I, Latehar in Misc. Criminal Application No. 734/2024 in connection with Chandwa P.S. Case No. 32/2018, whereby and whereunder, the prayer for bail of the appellant has been rejected.

The allegations reveal that there was an exchange of firing between the Police personnel and the extremists and after the extremists fled away, several incriminating articles were recovered from the place of occurrence.

Learned counsel for the appellant submits that though the appellant is named in the FIR, but no specific allegation has been levelled against him. It has further been submitted that the appellant is in custody since 25.10.2021 and some of the co-accused persons have been granted bail by this Court.

Mr. Anup Pawan Topno, learned A.P.P. has opposed the prayer for bail of the appellant and has submitted that apart from being named in the FIR, the appellant has got several criminal antecedents.

It appears from the status report that out of 14 chargesheet witnesses, only one witness has been examined so far. The allegations being general and omnibus in nature and considering the period of custody undergone by the appellant, we while setting aside the order dated 29.11.2024 passed by the learned Additional Sessions Judge-I, Latehar in Misc. Criminal Application No. 734/2024 in connection with Chandwa P.S. Case No. 32/2018, direct that the appellant be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Latehar in connection with Chandwa P.S. Case No. 32/2018, subject to the condition that he shall remain physically present before the learned trial court on each and every date till the conclusion of the trial.

This appeal is allowed.
