RANCHI, India, Nov. 12 -- Jharkhand High Court issued the following order on Oct. 13:
Heard Mr. Raja Ravi Shekhar, learned counsel appearing for the appellant and the learned Special P.P. appearing for the State.
This appeal is directed against the order dated 07.07.2025 passed in A.B. P. No. 259 of 2025 arising out of Tinpahar P. S. Case No. 7 of 2025 by the learned Additional Sessions Judge I, Rajmahal whereby and whereunder the prayer for anticipatory bail of the appellant has been rejected.
It has been alleged that on an information, a search was made and two minor girls and a minor boy were recovered and one person was apprehended namely, Ganga Paharia.
Submission has been advanced by the learned counsel for the appellant that there is no allegation against the appellant of trafficking the children. He further submits that Ganga Paharia has been granted bail by this court in Criminal Appeal (DB) No. 679 of 2025.
Learned Special P.P. for the State has opposed the prayer for anticipatory bail of the appellant and submitted that the statement of the victim who has been recovered clearly indicate about the attempt made by the appellant to take the children to Delhi.
It appears that out of three children, the statements of two children clearly indicates about the appellant of trying to allure the children to Delhi for the purpose of domestic work.
In view of the specific allegation against the appellant, we are not inclined to interfere in the order dated 07.07.2025 passed in A.B. P. No. 259 of 2025 arising out of Tinpahar P. S. Case No. 7 of 2025 by the learned Additional Sessions Judge I, Rajmahal and consequently this appeal is dismissed.
