RANCHI, India, June 28 -- Jharkhand High Court issued the following order on June 3:

1. Heard the learned counsel for the parties.

2. The instant bail application has been preferred by the petitioner for grant of regular bail for the offences registered under Sections 103 (1) / 3 (5) of the B.N. S., 2023 along with Section 27 of the Arms Act.

3. Learned counsel for the petitioner submits that the petitioner has clean antecedent and he has falsely been implicated in the present case. The allegation as alleged in the FIR is false and fabricated and the petitioner has not committed any offence. He further submits that the name of the petitioner has been transpired in this case merely on the basis of confessional statement of the co-accused namely, Suraj Mardi made before the Police which has no evidentiary value in the eyes of law. He further submits that nothing incriminating has been recovered from the conscious possession of the petitioner suggesting his complicity in the instant case in any manner. More so, the petitioner is languishing in judicial custody since 17.12.2024.

4. It is further submitted that co-accused persons have been granted bail by the co-ordinate bench of this Court vide orders dated 09.04.2025 passed in B.A. No. 2831 of 2025 and in B.A. No. 3658 of 2025.

5. Learned A.P.P. opposed the prayer of the petitioner for grant of bail.

6. Having regard to the facts of the case and looking into the allegation made against this petitioner, I am inclined to enlarge the petitioner on bail on furnishing bail bond of Rs. 20,000/- (Rs. Twenty Thousand Only) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge - Ist at Seraikella, in connection with S.T. Case No. 59 of 2025 arising out of Gamharia P.S. Case No. 135 of 2024.

7. It is made clear that till commencement of trial the petitioner shall report to the local police station every month and after commencement of trial he shall appear on each and every date before the learned trial court and he shall not threaten any witnesses and shall co-operate in trial and if any adverse report will come against this petitioner, the learned trial court shall be at liberty to cancel the bail of this petitioner.
