RANCHI, India, Sept. 2 -- Jharkhand High Court issued the following order on July 1:
I.A. No. 8654 of 2025
1. Heard Mr. Sahil, learned Counsel for the appellant and Mrs. Priya Shrestha, learned Spl. P.P.
2. This application has been preferred by the appellant for condoning the delay of 25 days in filing the appeal.
3. Having been satisfied with the reasons assigned in the instant application, the same is allowed and the delay of 25 days in filing the appeal is hereby condoned.
4. The aforesaid I.A. stands disposed of.
Cr. Appeal (D.B.) No. 794 of 2025
5. This appeal is directed against the order dated 08.05.2025 passed in Misc. Criminal Application No. 779 of 2025, arising out of Piparwar P.S. Case No. 34 of 2024 by the learned Additional Sessions Judge-III-, Chatra whereby and whereunder the prayer for bail of the appellant has been rejected.
6. It has been alleged that four persons were apprehended by the police and from their possession various incriminating articles were recovered.
7. Submission has been advanced by the learned Counsel for the appellant that the appellant was one of the persons apprehended by the police and from his possession two live cartridges, one damaged country made pistol and pamphlets of the extremist organization were recovered. It has been submitted that the appellant is in custody since 05.09.2024. Learned counsel adds that one of the co-accused similarly situated namely, Shankar Uraon @ Shankar Oraon has been granted bail by a Co-ordinate Bench of this Court in Criminal Appeal (DB) No. 1552 of 2024.
8. Learned Spl. P.P. has opposed the prayer for bail of the appellant.
9. Regard being had to the period of custody undergone by the appellant and the fact that one of the co-accused similarly situated having been granted bail by a Co-ordinate Bench of this Court, we, while setting aside the order dated 08.05.2025 passed in Misc. Criminal Application No. 779 of 2025, arising out of Piparwar P.S. Case No. 34 of 2024 by the learned Additional Sessions Judge-III-, Chatra, direct that the appellant, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of the learned Additional Sessions Judge-III-, Chatra in connection with S.T. No. 33 of 2025, arising out of Piparwar P.S. Case No. 34 of 2024.
10. Accordingly, this appeal is allowed.
