RANCHI, India, Aug. 14 -- Jharkhand High Court issued the following order on July 14:

Heard the parties.

The petitioner has been made accused in connection with Deoghar (Cyber) P.S. Case No.140 of 2024 registered for the offence punishable under Section 319(2)/318(4)/338/336(3)/340(2)/61 of the B.N.S., 2023 and Section 66B/66C/66D/84C of I.T. Act.

Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner was involved in cyber crime and he has defrauded the victims Sonamati Kumari and Suresh to the tune of Rs.3,000/- and Rs.12,690/- respectively. It is next submitted that the allegation against the petitioner is false. It is also submitted that one mobile phone along with SIM Card was recovered from the possession of the petitioner. It is then submitted that the petitioner has been in custody since 28.12.2024 as is evident from para-11 of the instant bail application. It is also submitted that the petitioner has no criminal antecedent as mentioned in para-12 of the instant bail application. It is further submitted that the petitioner undertakes to transfer Rs.3,000/- and Rs.12,690/- to the Bank Account of Sonamati Kumari and Suresh respectively without prejudice to his defence in this case. It is lastly submitted that the petitioner also undertakes to co-operate with the trial of the case. Hence, it is submitted that the petitioner be released on bail.

Learned counsel appearing for the State opposes the prayer for bail of the petitioner.

Considering the facts of this case, the above-named petitioner is directed to be enlarged on bail on showing proof of transfer of Rs.3,000/- and Rs.12,690/- to the Bank Account of Sonamati Kumari and Suresh respectively without prejudice to his defence in this case and on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-IIcum-Spl. Judge, Cyber Crime, Deoghar in connection with Deoghar (Cyber) P.S. Case No.140 of 2024 with the condition that he will co-operate with the trial of the case and furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case.
