Heard the learned counsel for the respective sides.
This appeal is directed against the order dated 07.05.2025 passed by learned AJC-XVIII-cum-Special Judge, ATS, Ranchi in MCA No. 676 of 2025 in connection with ATS P.S. Case No. 7/2023, whereby and whereunder, the prayer for bail of the appellant has been rejected.
It has been alleged that on account of extortion and firing one Chandan Sahu and Sonu Kumar were apprehended with firearm and forged Aadhaar Cards.
Submission has been advanced by the learned counsel for the appellant that the appellant has been implicated on the confessional statement of co-accused Chandan Sahu. It has been submitted that no incriminating articles were recovered from the possession of the appellant. Learned counsel adds that the appellant is in custody since 06.09.2024 and several of the co-accused persons similarly situated have been granted bail by a Coordinate Bench of this Court in Criminal Appeal (DB) No. 352 of 2025, Criminal Appeal (DB) No. 404 of 2024 and Criminal Appeal (DB) No. 745 of 2024.
Mr. Vineet Kumar Vashistha, learned Spl.P.P. has opposed the prayer for bail of the appellant and has submitted that the appellant has got several criminal antecedents.
However, considering the manner of implication of the appellant and the fact that several co-accused persons have been granted bail by a Coordinate Bench of this Court, we while setting aside the order dated 07.05.2025 passed by learned AJC-XVIII-cum-Special Judge, ATS, Ranchi in MCA No. 676 of 2025 in connection with ATS P.S. Case No. 7/2023, direct that the appellant be released on bail on furnishing bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like mount each to the satisfaction of learned AJC-XVIII-cum-Special Judge, ATS, Ranchi, in connection with ATS P.S. Case No. 7/2023.
This appeal is allowed.
