RANCHI, India, June 11 -- Jharkhand High Court issued the following order on May 15:

1. Heard the parties.

2. Petitioner has been made accused in connection with Telaiya P.S. Case No. 299 of 2024 for the offences registered under Sections 272, 274, 275 and 292 of the Bharatiya Nyaya Sanhita, 2023 and under Sections 47(a)(f) of Excise Act, pending in the court of learned Additional Chief Judicial Magistrate, Koderma.

3. Record reveals that this petitioner is involved in manufacturing of illicit mahuwa liquor and from the site, 80 liters of illicit Mahuwa Liquor and 3000 kg Jawa Mahuwa got recovered and the petitioner is also having criminal antecedent.

4. Learned counsel for the petitioner submitted that the petitioner is having no concern with the said site from where alleged recovery has been effected.

5. Learned A.P.P. opposes the prayer of bail of the petitioner on the premise that the petitioner is having criminal antecedent.

6. Considering the fact that recovery has already been made and the petitioner is in judicial custody since 03.04.2025, this Court is inclined to grant bail to the petitioner.

7. In the aforesaid facts and circumstances of the case, the petitioner named above, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand), with two sureties of the like amount each, to the satisfaction of learned Additional Chief Judicial Magistrate, Koderma in connection with Telaiya P.S. Case No. 299 of 2024.
