RANCHI, India, March 8 -- Jharkhand High Court issued the following order on Feb. 6:
1. The present writ petition has been filed for the following reliefs :-
"(a) for quashing the order dated 30.12.2024 (Ammerure-4) passed by the respondent no. 53 whereby and whereunder fresh representation dated 29.11.2024 filed by the petitioner in pursuance of the order dated 26.09.2024 passed in W.P. (C) No. 4987/2023 for opening Jamabandi and issuance of rent receipt in respect of land situated at MouzaShyamganj, Thana No. 413, Plot No. 590, Deoghar has been disposed off/rejected without following the new procedure of mutation, calling the record, notice from the District Sub-Registrar or National Archives of India or Department of Revenue, Land Reforms, Govt. of Jharkhand before passing the order and also without providing any notice/ show cause to the petitioner for hearing.
(b) for direction upon the respondent no. 4 for opening jamabandi in favour of petitioner in connection with total measuring land 3 acres plot no. 590 situated near Baidyanath Mandir, MouzaShyamganj, Dhobi Tola, Deoghar which has been possessed by the petitioner on the basis of deed of exchange and gift dated 15.01.1932.
(c) for direction upon the respondent no. 5 restraining them from interference from peaceful and legal possession of the petitioner from the part of the land of the petitioner as above without any authority of law."
2. After some arguments, learned counsel for the petitioner seeks permission to withdraw the present writ petition with a liberty to proceed in accordance with law after instituting a proper proceeding as authorized by law or by legislature because a result can only be produced through prescribed process and authorized adjudicator and not otherwise.
3. Learned counsel for the respondents have raised no objection.
4. Permission is accorded.
5. Accordingly, the present writ petition is, hereby, disposed of with a liberty to the petitioner to work out his remedy in accordance with law.
6. Pending interlocutory application, if any, stands disposed of.
