RANCHI, India, April 9 -- Jharkhand High Court issued the following order on March 9:
1. Heard learned counsel appearing on behalf of Petitioner and learned counsel appearing on behalf of the State.
2. The petitioner is apprehending his arrest in connection with Lokainayanpur P.S. Case No.10 of 2024, for the offence registered under Section 274, 275, 317 (5), 3(5) of B.N.S. and Section 47 (A)/55 of Excise Act, pending in the court of learned Judicial Magistrate 1st Class, Giridih.
3. Learned counsel appearing for the petitioner submits that the petitioner happened to be the owner of the car being BR 43C 8912. He also submits that the said car was handed over by the petitioner to one Sharvan Kumar and the allegations are made that the foreign liquor has been recovered in the said car. He also submits that the petitioner is having no criminal antecedent as disclosed in paragraph 13 of the petition.
4. Learned counsel appearing for the State opposed the prayer and submits that the petitioner happened to be the owner of the car, on which illegally foreign liquor was being carried.
5. Considering that the petitioner is having no criminal antecedent and he is the owner of the said car and it has been pointed out that the said car was handed over to one Sharvan Kumar and the car was being utilized by said Sharvan Kumar, in that view of the matter, the petitioner above named is directed to surrender before the learned Court within two weeks and the learned Court shall release the petitioner on such terms and condition and sureties, the learned Court may deem fit and proper.
