RANCHI, India, July 22 -- Jharkhand High Court issued the following order on June 23:

1. Petitioner entered into development agreement in the year 2009 and got building plan sanctioned being BC/54/445/10 over Municipal Survey Plot No.754, Khata No.227, Thana No.245, Ward No.54 situated at Village Kalyanpur, P.S. Jagarnathpur, District Ranchi.

2. Some dispute ensued at the stage of sanction of the map by Ranchi Municipal Corporation as the petitioner contended that building was shown to be constructed in the part of land which did not come under the development agreement.

3. Petitioner filed U.C. Case No.25 of 2013 before the Chief Executive Officer, Ranchi Municipal Corporation in this regard. This case was ultimately disposed of on the basis of the compromise in which respondent no.4 agreed to give a Flat in lieu of the said land which came under the building sanction and a development agreement was drawn afresh on 24.07.2014.

4. The main grievance of the petitioner is that he has not been allotted the Flat in terms of the said development agreement for which he had filed a representation under Section 31 of the Jharkhand Apartment (Flat) Ownership Act, 2011 with respondent no.3- Chief Executive Officer, Ranchi Municipal Corporation-cum- competent authority on 29.08.2024 which has not been still disposed of.

5. In view of the fact that representation is still pending before the competent authority, respondent no.3 is directed to dispose of the said representation within eight weeks from the date of receipt/production of copy of this order by way of a reasoned order after hearing the parties.

Writ Petition is disposed of. Interlocutory Application, if any, is disposed of.
