RANCHI, India, Dec. 23 -- Jharkhand High Court issued the following order on Nov. 24:

Heard Shailesh Kr. Singh, learned counsel for the appellant and learned A.P.P. for the State.

This interlocutory application has been preferred by the appellant for condoning a delay of 24 days in filing the appeal.

Having been satisfied with the reasons assigned in the instant application, the same is allowed and the delay of 24 days in filing the appeal is, hereby, condoned.

I.A. No. 15026 of 2025 stands disposed of.

Criminal Appeal (D.B.) No. 1397 of 2025

This appeal is directed against the order dated 02.09.2025, passed by the learned Additional Sessions Judge-XVI, Dhanbad, in B.P. No. 803 of 2025, arising out of Barwadda P.S. Case No. 156/2025, whereby and whereunder, the prayer for bail of the appellant has been rejected.

It has been alleged that in course of checking, two persons were apprehended and, on their disclosure, four other persons were apprehended with arms and ammunitions.

Submission has been advanced by the learned counsel for the appellant that from the possession of the appellant five cartridges were recovered. It has been submitted that some of the co-accused who were apprehended at the spot have been granted bail by a coordinate Bench of this Court in Criminal Appeal (D.B.) No. 1187 of 2025 and Criminal Appeal (D.B.) No. 1138 of 2025. Learned counsel submits that the appellant is in custody since 24.06.2025.

Learned A.P.P. has opposed the prayer for bail of the appellant.

On consideration of the period of custody undergone by the appellant and the fact that some of the co-accused have been granted bail by a coordinate Bench of this Court as noted above, we while setting aside the order dated 02.09.2025, passed by the learned Additional Sessions Judge-XVI, Dhanbad, in B.P. No. 803 of 2025, arising out of Barwadda P.S. Case No. 156/2025, direct that the appellant be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each, to the satisfaction of learned J.M.F.C., Dhanbad in connection with Barwadda P.S. Case No. 156/2025.

This appeal stands allowed.
