RANCHI, India, Oct. 17 -- Jharkhand High Court issued the following order on Sept. 16:

1. Learned counsel for the petitioner after arguing at length and the same having been responded by Mr. Anil Kumar, learned A.S.G.I. and Mr. Rajiv Ranjan, learned A.G. for the State.

2. Mr. Indrajit Sinha, learned counsel appearing for the petitioner, thereafter sought leave of this Court to withdraw the present writ petition with liberty to appear before the Director of Mines in pursuance of the show cause notice dated 13.05.2024, as contained in Letter No. 840.

3. There is no opposition by Mr. Rajiv Ranjan, learned Advocate General.

4. However, liberty is left open to the writ petitioner to raise all available factual as well as legal issues before the Director of Mines for its consideration in accordance with law.

5. The present writ petition is, therefore, disposed of with a liberty to the petitioner to appear before the Director of Mines by filing an appropriate response to the show cause notice dated 13.05.2024, which shall be filed within a period of three weeks from today.

6. The Director of Mines, Department of Mines and Geology, Government of Jharkhand, shall consider and take the final decision in accordance with law. If the response is not filed within the aforesaid period, the Director of Mines will be at liberty to proceed in accordance with law.

7. Learned counsel for the petitioner has undertaken to communicate this order forthwith to the petitioner.

8. The instant writ petition is dismissed as withdrawn and is accordingly disposed of.

9. Pending Interlocutory application(s), if any, also stands disposed of.

10. Consequently, the interim order dated 01.05.2025 also stands vacated.
