RANCHI, India, March 1 -- Jharkhand High Court issued the following order on Jan. 29:
Heard Mr. Aman Shekhar, learned counsel appearing for the appellant and the learned A.P.P. appearing for the State assisted by Ms. Vidhika Saboo, learned counsel for the informant.
This appeal is directed against the order dated 02.01.2026 passed in B. P. No. 434 of 2025 in connection with AHTU P. S. Case No. 3 of 2024 by the learned Sessions Judge, Sahibganj whereby and whereunder the prayer for bail of the appellant has been rejected.
It has been alleged that the daughter of the informant was taken away by the appellant sometimes in May 2019 on the pretext of getting her employed. It has further been alleged that the appellant was running a placement agency and after one year of taking away of the daughter of the informant, the conversation between the informant and his daughter stopped and when the informant went to Delhi in search of his daughter, she could not be traced out.
Learned counsel for the appellant has submitted that the appellant is in custody since 16.06.2025. It has further been submitted that the victim has been traced out and in support of which an application dated 03.12.2025 has been brought on record which has been addressed to the Chief Judicial Magistrate, Sahibganj.
Learned A.P.P. for the State has opposed the prayer for bail of the appellant.
So far as the learned counsel for the informant is concerned, she has stated that she does not have any objection, if the appellant is granted bail.
It appears that the prayer for bail of the informant was earlier rejected on 20.11.2025 in Cr. Appeal (DB) No. 1249 of 2025. One of the reasons for rejecting the prayer for bail of the appellant was the fact that the victim was traceless. However subsequently the victim was recovered which would be evident from the application made before the learned C.J.M., Sahibganj.
On consideration of the said fact and the period of custody undergone by the appellant, we while setting aside the order 02.01.2026 passed in B. P. No. 434 of 2025 by the learned Sessions Judge, Sahibganj direct that the appellant above named be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each, to the satisfaction of the learned Chief Judicial Magistrate, Sahibganj in connection in connection with AHTU P. S. Case No. 3 of 2024.
This appeal is allowed.
