RANCHI, India, Sept. 25 -- Jharkhand High Court issued the following order on Aug. 25:

1. This writ petition is under Article 226 of the Constitution of India seeking for the following reliefs: -

"That through the instant writ petition, the petitioner prays before this Hon'ble Court for issuance of an appropriate writ(s), order(s) and/or direction(s) upon the respondents to extend the lease period of the stone mining lease of the petitioner for a period of 01 Year 06 months, which was granted for a period of two yearsw.e.f. 01.04.2020 to 31.03.2022 vide Supplementary Lease Deed No.1972/1941 registered on 01.10.2021 over an area of 2.05 acres of land bearing R.S. Plot No.42(P), New Plot No.53, R.S. Khata No.140, New Khata No.189 situated in Mouza- Oyana, Thana- Lohardaga, Thana No.140 in the district of Lohardaga, in view of the provision prescribed under Clause 5 of Part IX of the Jharkhand Minor Mineral Concession Rules, 2004, as the stone mining lease remained closed from 01.04.2020 to 30.09.2021 i.e. for a period of 01 Year 06 months due to the time elapsed in the process of registration of the Supplementary Lease Deed."

At the outset, the learned counsel appearing for the State has raised objection on the maintainability of the present writ petition by saying that the issue involved in the present case is similar to the issue involved in W.P(C) No.3560 of 2025 which was dismissed vide order dated 08.08.2025 passed by a co-ordinate Division Bench of this Court and, as such, this case is fit to be dismissed in view of the Rule as amended by insertion of provision of Rule 9(a), Rule 9(b), and other allied provisions by virtue of amendment inserted in 2017 under the Jharkhand Minor Mineral Concession Rules, 2004.

3. Accordingly, in view of the order dated 08.08.2025 passed in W.P(C) No.3560 of 2025, the instant writ petition stands dismissed.

4. Pending interlocutory application(s), if any, stands disposed of.
