RANCHI, India, Jan. 3 -- Jharkhand High Court issued the following order on Dec. 2:
Heard Md. Yasir Arafat, learned counsel for the appellant and learned A.P.P. for the State.
This appeal is directed against the order dated 24.06.2025, passed by the learned Special Judge (POCSO), Sahibganj, in M.C.A. No. 305/2025, arising out of Ranga P.S. Case No. 38/2025, whereby and whereunder, the prayer for bail of the appellant has been rejected.
It has been alleged that the daughter of the informant was subjected to rape by the appellant.
Submission has been advanced by the learned counsel for the appellant that the victim has subsequently solemnized marriage and the Nikahnama indicates that the age of the victim is 19 years which would further reveal that at the time of the incident the victim was a major. Learned counsel submits that the appellant is in custody since 08.04.2025.
Learned A.P.P. for the State has opposed the prayer for bail of the appellant and has submitted that earlier also the younger sister of the victim was subjected to rape by the appellant and so far as the victim is concerned, she was recovered by the Police and in her 164 Cr.P.C. statement she has categorically stated about the factum of rape committed upon her by the appellant.
On consideration of the nature of allegation levelled against the appellant which has been supported in the 164 Cr.P.C. statement of the victim, we are not inclined to interfere in the order dated 24.06.2025 passed in M.C.A. No. 305/2025, arising out of Ranga P.S. Case No. 38/2025, by the learned Special Judge (POCSO), Sahibganj, and consequently we dismiss this appeal.
