RANCHI, India, Oct. 9 -- Jharkhand High Court issued the following order on Sept. 9:

1. Heard learned counsel appearing on behalf of Petitioner and learned APP appearing on behalf of the State.

2. The petitioner is apprehending his arrest in connection with Katkamsandi P.S. Case No.83 of 2025, for the alleged offences registered under Sections 115(2)/126(2)/118(2)/109/125/3(5) of BNS, 2023, pending in the Court of learned Civil Judge Senior Division cum Judicial Magistrate, 1st Class, Hazaribag.

Learned counsel appearing for the petitioner submits that the petitioner has been falsely implicated in this case as the alleged occurrence is of dated 07.04.2025, whereas the FIR has been lodged on 21.04.2025. He submits that in the FIR, the allegation has been made that this petitioner has assaulted behind the back of the brother of the informant, however the injury is said to be in front portion of the body. He submits that the petitioner and the informant are neighbours and the brother of this petitioner has helped the victim by way of giving a sum of Rs.1,75,000/- for treatment and buttress to this argument, he refers to Annexure -2, which is the money transaction document.

4. Learned counsel for the State opposed the prayer and submits that the injuries have been received.

In view of the above and considering that the brother of the petitioner has helped by way of giving Rs.1,75,000/- for treatment and the allegation of assault has been made in the back side of the body of the brother of the informant, but the injuries has been found in front side, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, the petitioner above named is directed to surrender before the learned Court within three weeks from the date of receipt of the order and on the event of his surrender / arrest, he shall be released on bail on furnishing bail bond of Rs.25,000/- (Twenty-Five Thousand) with two sureties of the like amount of each to the satisfaction of learned Civil Judge Senior Division cum Judicial Magistrate, 1st Class, Hazaribag, in connection with Katkamsandi P.S. Case No.83 of 2025, subject to the condition as laid down under Section 482(2) of Bhartiya Nagarik Suraksha Sanhita, 2023.

7. This Anticipatory Bail Application is accordingly allowed and disposed of.
