RANCHI, India, Oct. 9 -- Jharkhand High Court issued the following order on Sept. 9:
1. Heard learned counsel appearing on behalf of Petitioners and learned APP appearing on behalf of the State.
2. The petitioners are apprehending their arrest in connection with Pathargama P.S. Case No.108 of 2025, for the alleged offences registered under Sections 126(2), 115(2) 118(1), 191(2), 190, 303(2), 352, 109, 76 and 3(5) of Bhartiya Nyaya Sanhita, 2023, pending in the Court of learned SDJM, Godda.
3. Learned counsel appearing for the petitioners submits that there is case and counter case between the parties and the petitioners and informant side are the family members. He further submits that the first case has been lodged by the petitioner No.1 and thereafter this case has been lodged and there are general and omnibus allegations against all the accused persons and the said dispute has arisen out of land.
4. Learned counsel for the State opposed the prayer and submits that the injuries have been received.
5. In view of the above and considering that the petitioners are ladies and there are general and omnibus allegations against the petitioners and the petitioner No.1 has lodged the first case against the informant side, thereafter the present case has been lodged, I am inclined to grant anticipatory bail to the petitioners.
6. Accordingly, the petitioners above named are directed to surrender before the learned Court within three weeks from the date of receipt of the order and on the event of their surrender / arrest, they shall be released on bail on furnishing bail bond of Rs.25,000/- (Twenty-Five Thousand) each with two sureties of the like amount of each to the satisfaction of learned SDJM, Godda, in connection with Pathargama P.S. Case No.108 of 2025subject to the condition as laid down under Section 482(2) of Bhartiya Nagarik Suraksha Sanhita, 2023.
7. This Anticipatory Bail Application is accordingly allowed and disposed of.
